Terms and Conditions

1. Definitions

In these Terms and Conditions:

• "Client" means the person or entity purchasing design services from MyPixelGraphic.
• "Services" means the graphic design services provided by MyPixelGraphic.
• "Deliverables" means the final design files provided to the Client upon completion of Services.
• "Stripe" means Stripe, Inc., the payment processor used by MyPixelGraphic.

2. Services and Payment

1. MyPixelGraphic agrees to provide graphic design Services as described in the selected service package.
2. The Client agrees to pay the full amount due for Services as specified at the time of purchase.
3. All payments are processed securely through Stripe. MyPixelGraphic does not store or process credit card information directly.
4. For custom projects exceeding $300, MyPixelGraphic may require a 50% deposit before beginning work, with the balance due upon completion.
5. All prices are quoted in USD unless otherwise specified.

3. Refund Policy

1. Due to the custom nature of design work, MyPixelGraphic offers refunds only under the following conditions:
   • The Client cancels the project before any design work has begun (100% refund)
   • MyPixelGraphic is unable to complete the agreed Services (pro-rated refund)
2. No refunds will be issued after final design files have been delivered and accepted by the Client.
3. If the Client is unsatisfied with the design, MyPixelGraphic will work to make revisions until the Client is satisfied, within the agreed number of revisions for their selected package.

4. Intellectual Property

1. Upon full payment, all rights to the final Deliverables shall be transferred to the Client.
2. MyPixelGraphic retains the right to display the completed work in portfolios, websites, and other promotional materials.
3. The Client warrants that any materials provided to MyPixelGraphic for inclusion in the designs do not infringe on any third-party rights.
4. MyPixelGraphic is not responsible for any trademark or copyright issues that may arise from the Client's use of the Deliverables.

5. Client Responsibilities

1. The Client agrees to provide timely and clear feedback during the design process.
2. The Client is responsible for reviewing all proofs carefully and notifying MyPixelGraphic of any errors within the revision period.
3. Delays caused by the Client may result in additional fees or extension of delivery timelines.

6. Delivery and Acceptance

1. Delivery timelines are estimates and not guaranteed, as they depend on client responsiveness and project complexity.
2. Deliverables will be provided in the formats specified in the service description unless otherwise agreed in writing.
3. The Client has 7 days from delivery to request any final revisions. After this period, the project will be considered complete.

7. Limitation of Liability

1. MyPixelGraphic's liability under any claim arising from these Terms shall be limited to the fees paid by the Client for the Services.
2. MyPixelGraphic shall not be liable for any indirect, incidental, or consequential damages.

8. Disputes

1. Any disputes arising from these Terms shall be resolved through good faith negotiation between the parties.
2. If a dispute cannot be resolved amicably, either party may initiate mediation before pursuing legal action.
3. These Terms shall be governed by applicable law, and any legal proceedings shall follow standard procedures based on the nature of the dispute.

9. Changes to Terms

1. MyPixelGraphic reserves the right to modify these Terms at any time. The current version will always be posted on our website.
2. Continued use of our Services after changes constitutes acceptance of the modified Terms.
